SkillShiftEd Website Terms of Service
For skillshifted.com and related SkillShiftEd website pages
Effective Date: July 31, 2026 | Last Updated: July 31, 2026
These Website Terms of Service, also referred to as the Terms of Use (the “Terms”), are a legal agreement between you and Lovegevity.com, Inc., which operates SkillShiftEd as a division and brand (“SkillShiftEd,” “we,” “us,” or “our”). These Terms govern your access to and use of skillshifted.com, including its pages, forms, scheduling tools, content, and related website features (collectively, the “Site”).
By accessing or using the Site, submitting an inquiry or proposal, or selecting a checkbox indicating acceptance, you agree to these Terms. If you do not agree, do not use the Site or submit information through it.
1. Scope of These Terms
These Terms apply to the public Site and the preliminary process through which domain experts, instructors, consultants, authors, trainers, and other prospective collaborators may learn about SkillShiftEd, submit information, or schedule an introductory call.
These Terms do not by themselves create a paid engagement, course-development relationship, licensing arrangement, distribution commitment, employment relationship, or legally recognized partnership. Any approved engagement will be governed by a separate written agreement signed by the applicable parties. If a separate signed agreement conflicts with these Terms, that signed agreement controls for the subject matter it covers.
3. Site Purpose; No Offer or Guarantee
The Site provides general information about SkillShiftEd’s course-development and distribution services and allows prospective domain experts to express interest. Site content, calls, assessments, preliminary discussions, and proposal submissions are informational and exploratory only.
SkillShiftEd does not guarantee that any person, idea, course, program, or proposal will be accepted, developed, published, accredited, approved by a college or university, distributed through any institution, marketed, sold, or generate revenue, royalties, enrollment, credentials, employment, or other results. SkillShiftEd is not itself an accrediting agency, and references to accredited colleges, universities, programs, networks, or distribution channels do not mean that every proposed program will receive institutional or accrediting approval.
4. Domain Expert Submissions
You may submit information about your expertise, experience, course concept, business, audience, credentials, intellectual property, or proposed educational program (“Submission”). You represent and warrant that:
- the Submission is accurate and not materially misleading;
- you own the Submission or have all rights and permissions needed to provide it;
- the Submission does not infringe, misappropriate, or violate another person’s intellectual-property, privacy, publicity, confidentiality, contractual, or other rights; and
- the Submission does not contain unlawful, defamatory, discriminatory, deceptive, malicious, or harmful material.
You retain ownership of your Submission. You grant SkillShiftEd a limited, non-exclusive, worldwide, royalty-free license to receive, store, copy, internally review, evaluate, summarize, and share the Submission with personnel, professional advisers, service providers, and potential educational or distribution partners solely to assess, discuss, or pursue a potential relationship with you. Any broader development, adaptation, commercialization, licensing, publishing, or distribution rights must be addressed in a separate signed agreement.
5. Confidentiality and Trade Secrets
Unless SkillShiftEd has signed a separate nondisclosure agreement covering your Submission, information submitted through the Site or discussed during an introductory call will not be treated as confidential. Do not submit trade secrets, source files, unreleased proprietary materials, regulated personal information, student records, health information, financial account information, government identifiers, or other highly sensitive information through public Site forms.
SkillShiftEd may already be developing or evaluating ideas, courses, or services that are similar to your Submission. Similarity alone does not create liability or an obligation to compensate you.
6. Independent Relationship of Experts
The word “partner” on the Site is a commercial description and does not, by itself, create a legal partnership, joint venture, fiduciary relationship, franchise, agency, employment relationship, or authority to bind SkillShiftEd or Lovegevity.com, Inc. Prospective and approved domain experts are independent businesses or independent contractors unless a separate signed agreement expressly states otherwise.
You may not represent that you are an employee, agent, accredited representative, legal partner, or authorized spokesperson of SkillShiftEd, Lovegevity.com, Inc., or any college, university, accreditor, or distribution partner unless you have express written authorization.
7. User Accounts and Security
Some Site features may require an account. You must provide accurate account information, protect your credentials, use reasonable security measures, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account except to the extent caused by our failure to use legally required safeguards.
8. Acceptable Use
You may use the Site only for lawful purposes. You may not:
- attempt to gain unauthorized access to the Site, accounts, systems, or data;
- interfere with, overload, damage, disable, or circumvent the Site or its security controls;
- use bots, scrapers, crawlers, automated extraction, or similar means except as permitted by robots.txt or our written authorization;
- upload malware, malicious code, or content designed to compromise systems or users;
- impersonate another person or misrepresent your identity, qualifications, affiliations, or authority;
- use Site content or data to build a competing dataset, model, or service in violation of applicable law or our intellectual-property rights;
- collect personal information from other users without authorization; or
- use the Site in a way that violates law, third-party rights, or these Terms.
9. SkillShiftEd Content and Intellectual Property
The Site and its text, graphics, logos, designs, videos, software, trademarks, service marks, and other content are owned by or licensed to SkillShiftEd, Lovegevity.com, Inc., or their licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own lawful business evaluation. No other rights are granted by implication, estoppel, or otherwise.
You may not copy, modify, distribute, sell, license, publicly display, create derivative works from, or commercially exploit Site content without prior written permission, except as allowed by law.
10. Feedback
If you voluntarily provide suggestions or feedback about the Site or our services, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or compensation. This section does not transfer ownership of your course content or other substantive Submission.
11. Communications, Email, Calls, and Text Messages
By providing contact information, you authorize us to contact you about your inquiry, scheduled meetings, proposal, account, or potential business relationship by email or telephone. Transactional or relationship communications may be necessary to respond to your request. Text messages are governed by the separate SMS terms below and are sent only when supported by valid consent or otherwise permitted by law.
Marketing emails will include legally required identification and opt-out mechanisms. Consent to receive marketing calls or text messages is not a condition of purchasing or receiving services. Where required by law, automated or marketing calls and texts will be sent only after separate, valid consent, and you may revoke consent through any reasonable method, including by replying STOP to text messages when supported.
SMS Messaging Program
SMS consent is collected only through the LeadConnector chat widget embedded on skillshifted.com. The widget presents two separate, optional, unchecked consent choices: one for informational and transactional messages, and one for promotional messages. Lovegevity.com, Inc., operating as SkillShiftEd, sends only the categories you select to the mobile number you provide. Message frequency varies based on your interactions with us. Message and data rates may apply. Website forms that collect contact information for booking or applications do not collect SMS consent.
Reply STOP to any message to opt out. After you send STOP, we may send one final message confirming your opt-out. Reply HELP for help, email partners@skillshifted.com, or call (310) 600-8511. Consent to receive text messages is optional and is not a condition of purchase or service. You must be at least 18 years old or have the permission of a parent or legal guardian to enroll.
SMS opt-in consent is optional, is not required to submit a form, and is not shared with third parties or affiliates for marketing or promotional purposes. We do not sell, rent, or share SMS opt-in consent or mobile numbers collected for SMS purposes with third parties or affiliates for their marketing or promotional purposes. Mobile information may be disclosed only to messaging providers, telecommunications carriers, and subcontractors as needed to deliver and support the SMS program; they may not use it for their own marketing.
Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. Your participation is also subject to our Privacy Policy. We may change or discontinue the SMS program at any time.
12. Third-Party Services and Educational Institutions
The Site may integrate with or link to third-party services, including scheduling, video-conferencing, customer-relationship management, analytics, hosting, communications, payment, learning-management, social-media, college, university, or distribution platforms. Third parties are responsible for their own services, terms, privacy practices, availability, and decisions.
SkillShiftEd does not control and is not responsible for the independent acts, admission decisions, accreditation decisions, approval processes, policies, or performance of colleges, universities, accreditors, or other third parties.
13. Privacy
Our Privacy Policy explains how we collect, use, disclose, and retain personal information. By using the Site, you acknowledge that you have reviewed the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
14. Copyright or Rights Complaints
If you believe Site content infringes your copyright or other rights, send a detailed written notice to hello@lovegevity.com. Include your contact information, identification of the protected work or right, identification and location of the challenged material, the basis for your complaint, and a statement that the information you provide is accurate and submitted in good faith. We may request additional information before acting.
15. Site Availability and Changes
We may modify, suspend, restrict, or discontinue any Site feature at any time. We do not guarantee uninterrupted, secure, or error-free operation. We may correct errors and update information without notice, but we are not obligated to update all Site content immediately.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SKILLSHIFTED DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.
NO INFORMATION ON THE SITE IS LEGAL, TAX, FINANCIAL, EMPLOYMENT, ACCREDITATION, OR INVESTMENT ADVICE. YOU ARE RESPONSIBLE FOR OBTAINING YOUR OWN PROFESSIONAL ADVICE AND FOR EVALUATING ANY BUSINESS OR EDUCATIONAL OPPORTUNITY.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLSHIFTED, LOVEGEVITY.COM, INC., AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, OPPORTUNITIES, DATA, GOODWILL, OR BUSINESS; OR DAMAGES ARISING FROM THIRD-PARTY SERVICES, INSTITUTIONAL DECISIONS, OR UNAUTHORIZED ACCESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE SKILLSHIFTED PARTIES FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID DIRECTLY TO SKILLSHIFTED FOR USE OF THE PUBLIC SITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, these provisions apply only to the extent permitted by law and do not limit rights that cannot lawfully be waived.
18. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless the SkillShiftEd parties from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your material breach of these Terms, or your Submission’s infringement or violation of another person’s rights. This obligation does not apply to the extent a claim was caused by the SkillShiftEd party’s own negligence, willful misconduct, or legal violation.
19. Suspension and Termination
We may suspend or terminate your Site access if we reasonably believe you violated these Terms, created security or legal risk, or misused the Site. You may stop using the Site at any time. Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, submissions, disclaimers, liability, indemnification, disputes, and general terms.
20. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Except where applicable law requires otherwise, any action arising out of or relating to the Site or these Terms must be brought exclusively in the state courts located in Placer County, California, or the United States District Court for the Eastern District of California, and each party consents to personal jurisdiction and venue there.
21. Changes to These Terms
We may update these Terms by posting a revised version and updating the “Last Updated” date. Material changes will be communicated as required by law. Changes apply prospectively from their effective date. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms, but changes will not retroactively alter a separately signed agreement.
22. General Terms
These Terms and the Privacy Policy are the entire agreement governing use of the public Site, except for any separate signed agreement. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, merger, acquisition, asset transfer, or operation of law. Headings are for convenience only.
